FBR Establishes Panels for Section 37A and 40B Oversight

In a move to enhance accountability and build trust with the business community, the Federal Board of Revenue (FBR) has announced the formation of two specialized committees. These panels are tasked with overseeing the implementation of Section 37A and Section 40B of the Sales Tax Act, 1990, and will serve as a crucial mechanism for addressing taxpayer grievances.

The establishment of these committees is a direct response to concerns from taxpayers and business associations regarding the fairness and transparency of enforcement actions by tax officials. The FBR’s new initiative aims to provide a structured platform for dispute resolution and regular review of the conduct of its field formations.

Grievance Committee for Arrests under Section 37A

The first committee has been specifically created to address grievances related to arrests made under sub-sections (8) and (9) of Section 37A. Its composition is designed to ensure a balanced and independent review process, including:

  • Member Inland Revenue (IR) Operations, FBR
  • Member Legal IR, FBR
  • A nominee from the Federation of Pakistan Chambers of Commerce and Industry (FPCCI)
  • A nominee from the local chamber of commerce relevant to the arrested individual

The Secretary (Sales Tax – Operations) IR will act as the committee secretary. This body will meet bi-weekly to review complaints and grievances. If the committee identifies any instance of maladministration, it will report its findings to the FBR chairman, who can then take necessary action against the officials involved. The committee also has the authority to invite other business community representatives to participate as needed.

Panel for Field Operations under Section 40B

A second, separate committee has been formed to oversee field operations under Section 40B of the Sales Tax Act. This panel is intended to ensure that monitoring and enforcement activities are conducted fairly and in accordance with the law. Its members include:

  • Member IR Operations, FBR
  • Member Legal IR, FBR
  • Nominees from the FPCCI, Karachi Chamber of Commerce and Industry, and Lahore Chamber of Commerce and Industry

The Chief (ST-Operations) IR will serve as the secretary for this committee. Like the first, this group is empowered to co-opt representatives from relevant sectors. It will also convene fortnightly to review enforcement activities and solicit input from stakeholders, particularly from sector-specific associations.

The FBR’s creation of these high-level committees signals a significant step towards greater taxpayer facilitation and institutional accountability. By formalizing these redressal mechanisms, the FBR aims to foster a more cooperative and transparent relationship with the business community, ultimately improving the efficiency and fairness of tax enforcement.
